By accessing or using the RestWell platform ("Service"), operated by Trident Business Group ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all visitors, users, and others who access or use the Service, including parents, caregivers, and sleep consultants.
RestWell is a sleep wellness platform that provides educational resources, sleep tracking tools, and access to certified sleep consultants for families and individuals. Our services include but are not limited to: sleep assessments, personalized sleep plans, sleep tracking and logging, AI-powered insights, appointment booking, educational content, courses, and one-on-one consultations with certified sleep consultants.
RestWell is not a medical provider and does not offer medical advice, diagnosis, or treatment. The information, guidance, and recommendations provided through this platform — including those from our sleep consultants and AI-powered tools — are for educational and informational purposes only and do not constitute medical advice.
You should not rely on information provided through RestWell as a substitute for professional medical advice. Always seek the guidance of a qualified physician or healthcare provider with any questions you may have regarding a medical condition, sleep disorder, or your child's health. Never disregard professional medical advice or delay seeking it because of something you have read or received through RestWell.
If you believe your child or any family member is experiencing a medical emergency, call your local emergency services immediately. RestWell consultants are certified sleep specialists, not medical doctors, and their guidance should be considered supplementary to — not a replacement for — professional medical care.
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You may not share your account with others, but you may invite family members through the Family Sharing feature. We reserve the right to suspend or terminate accounts that violate these terms.
Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion. Content purchases (eBooks, courses) are non-refundable once accessed.
We reserve the right to change subscription fees upon reasonable notice. Continued use of the Service after a fee change constitutes acceptance of the new fees. All payments are processed securely through Stripe, our third-party payment processor. Promotional codes and discounts are subject to their individual terms and may be revoked at any time.
RestWell connects users with independent sleep consultants who provide guidance based on their training and certifications. While we vet our consultants for relevant qualifications, the advice and recommendations provided by consultants represent their professional opinions and should not be interpreted as medical advice. Sleep consultants using our platform are independent contractors, not employees of Trident Business Group. RestWell does not guarantee specific outcomes from consultant interactions.
Appointment scheduling, cancellation, and rescheduling are subject to the availability of consultants and the policies outlined on our booking page. We encourage users to provide at least 24 hours' notice for cancellations. RestWell reserves the right to remove consultants who do not meet our quality standards or code of conduct.
By using RestWell, you acknowledge and agree that you are voluntarily participating in sleep wellness activities and implementing sleep strategies at your own risk. You understand that every child and family is different, and results may vary. You assume full responsibility for any decisions you make based on information or guidance received through the Service, including any sleep training methods, schedule adjustments, or environmental changes you implement.
To the maximum extent permitted by applicable law, RestWell, Trident Business Group, its officers, directors, employees, consultants, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
In no event shall our aggregate liability exceed the amount you have paid to RestWell in the twelve (12) months preceding the claim. This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We make no guarantees regarding the effectiveness of any sleep plans, strategies, or recommendations provided through the Service.
You agree to indemnify, defend, and hold harmless RestWell, Trident Business Group, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any actions you take based on information or guidance received through the Service.
You retain ownership of any content you submit through the Service (such as sleep logs, notes, and messages). By submitting content, you grant us a limited license to use, store, and process that content solely for the purpose of providing and improving the Service. You agree not to submit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of Trident Business Group. This includes all sleep plans, educational materials, AI-generated insights, and course content. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. Your sleep data remains your property.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including sensitive health-related data. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and associated data at any time through the account settings or by contacting us. Upon termination, your data will be handled according to our Privacy Policy.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.
These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in Calgary, Alberta, unless otherwise required by applicable consumer protection laws.
